1. Acceptance of Terms

By creating an account or using any part of the Fitgly platform ("Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you and Fitgly Technologies ("Company", "we", "us", or "our").

2. Use of Service

The Service is designed for fitness businesses (gym managers), fitness professionals (trainers), and individuals (trainees) aged 16 or older. By using the Service, you represent that:

• You are at least 16 years of age.
• You have the legal capacity to enter into a binding agreement.
• Any registration information you provide is accurate and current.
• You will use the Service only for its intended, lawful purposes.

3. Account Registration

You must create an account to access the Service. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account, whether authorised by you or not.
• Notifying us immediately at security@fitgly.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or our usage policies.

4. Subscription & Billing

Gym manager accounts are offered under a subscription model. Key billing terms:

• Free trial: New gym accounts receive a free trial period. No credit card is required to start a trial.
• Paid plans: After the trial, continued access requires a paid subscription. Pricing is shown on our Pricing page.
• Auto-renewal: Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds: Payments are non-refundable except where required by applicable law. Contact us within 14 days of a charge if you believe it was made in error.
• Price changes:We will provide at least 30 days' notice before changing subscription prices.

5. Intellectual Property

The Service and all its original content, features, and functionality are owned by Fitgly Technologies and protected by applicable intellectual property laws. You may not:

• Copy, modify, distribute, sell, or lease any part of our platform or its underlying software.
• Reverse-engineer or attempt to extract the source code of the Service.
• Use our trademarks, logos, or brand assets without prior written permission.

The open-source exercise library (873+ exercises) is sourced from the free-exercise-db project, licensed under its respective open-source licence.

6. User Content

Content you upload to the platform (workout plans, progress photos, meal logs, messages) remains yours. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and process it solely to provide the Service.

You are responsible for ensuring your content does not infringe third-party rights, violate laws, or contain harmful material. We reserve the right to remove content that violates these Terms.

7. Prohibited Activities

When using the Service, you must not:

• Violate any applicable law, regulation, or third-party right.
• Attempt to gain unauthorised access to any system, account, or data.
• Transmit malware, spam, or any harmful code.
• Scrape, crawl, or harvest data from the platform without express permission.
• Impersonate another person or misrepresent your affiliation with any entity.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to provide competing software products or services.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• The results obtained from the Service will be accurate or reliable.

Health disclaimer: Fitness data, calorie estimates, and nutrition targets provided by the platform are for informational purposes only and are not a substitute for professional medical advice. Always consult a qualified healthcare professional before beginning any fitness or diet programme.

9. Limitation of Liability

To the fullest extent permitted by law, Fitgly Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to Fitgly Technologies' place of registration, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make significant changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify active users by email or prominent in-app notification at least 14 days before the changes take effect.

Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use and delete your account.
